AN ACT making an appropriation to the Department of Education to administer a grant program to increase the ratio of school nurses to pupils; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 There is hereby appropriated from the state general fund to the Department of Education the sum of $3,000,000 for a grant program whereby school districts may apply for money to hire school nurses to attempt to achieve the ratio of one school nurse for every 1,000 pupils enrolled in the school district pursuant to the requirement set forth in section 5 of chapter 535, Statutes of Nevada 1991.
Sec. 2 1. The money appropriated by section 1 of this act:
(a) Must be distributed by the Department of Education to the school districts based on need and not on a first-come, first-served basis;
(b) Must only be used to hire additional nurses for the school district who are qualified pursuant to NRS 391.207 and the regulations adopted pursuant thereto; and
(c) Must only be used to pay the salary of each school nurse during the first year of employment with the district.
2. Money granted to a school district from the appropriation made by section 1 of this act must not be counted in determining the financial ability of a local government employer for purposes of collective bargaining and must not be used to:
(a) Pay any monetary benefits recommended by a factfinder pursuant to chapter 288 of NRS; or
(b) Adjust any salary or benefit of an employee of the school district.
Sec. 3 The Department of Education shall not expend, or allocate to any school district for expenditure, money from this appropriation unless at least an equal amount is committed for expenditure by the district.
Sec. 4 Any remaining balance of the appropriation made by section 1 of this act must not be committed for expenditure after June 30, 1999, and reverts to the state general fund as soon as all payments of money committed have been made.
Sec. 5 This act becomes effective upon passage and approval or on June 30, 1997, whichever occurs earlier.
