AN ACT relating to vital statistics; requiring the reporting to the state registrar of vital statistics of the marital status of women who give birth; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 Chapter 440 of NRS is hereby amended by adding thereto a new section to read as follows:
1. A medical facility in which a woman gives birth shall attempt to determine the marital status of the woman by asking her to declare her marital status. If the woman refuses to declare her marital status, the medical facility may use specified factors to determine it. The state registrar shall establish such factors.
2. A medical facility shall record the marital status of each woman who gives birth in the facility, as determined pursuant to subsection 1, and transmit the information to the county health officer of the county in which the facility is located. The county health officer shall record the information and transmit it to the state registrar no later than July 1 of each year.
3. As used in this section, "medical facility" includes, but is not limited to, a hospital, clinic, obstetric center or other facility in which a person licensed by this state as a provider of health care assisted or attended the birth of a child.
Sec. 2 The provisions of subsection 1 of NRS 354.599 do not apply to any additional expenses of a local government that are related to the provisions of this act.
Sec. 3 This act becomes effective on July 1, 1997.
