AN ACT relating to hazardous materials; prohibiting the sale or use of certain highly flammable refrigerants; providing a penalty; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 Chapter 459 of NRS is hereby amended by adding thereto a new section to read as follows:
1. A person shall not use, sell or offer to sell a product that is intended for use as a refrigerant for the air-conditioning system of a motor vehicle or a residential, commercial or industrial structure or for a refrigerator or other cooling or heating device unless the product:
(a) Has been approved for the intended use by the Administrator of the United States Environmental Protection Agency; or
(b) Complies with one of the following standards of flammability:
(1) SAE J639 or SAE J1657 of the Society of Automotive Engineers;
(2) ASHRAE Standard 34-1992 of the American Society of Heating, Refrigerating and Air Conditioning Engineers, Inc.;
(3) UL 2182 of the Underwriters Laboratories; or
(4) ASTM E681-85 of the American Society for Testing and Materials.
2. A person who violates the provisions of subsection 1 is guilty of a misdemeanor.
Sec. 2 The amendatory provisions of this act do not apply to offenses that are committed before October 1, 1997.
Sec. 3 The provisions of subsection 1 of NRS 354.599 do not apply to any additional expenses of a local government that are related to the provisions of this act.
