SUMMARY--Revises provisions regarding printing services for state agencies. (BDR 29-962)

EXPLANATION - Matter in italics is new; matter in brackets [ ] is material to be omitted.

AN ACT relating to state agencies; requiring the chief of the purchasing division of the department of administration to give a preference of 5 percent to a commercial printing establishment located in this state under certain circumstances; requiring the University and Community College System of Nevada to obtain printed material or printing services through the chief of the purchasing division under certain circumstances; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 NRS 344.160 is hereby amended to read as follows:
344.160 1. [Should any state] If an officer, a commissioner, a trustee [or superintendent determine] , a superintendent or a regent of this state determines that his office, department or institution requires brochures, booklets, stationery, blanks, forms, typesetting, printing or binding which cannot be produced or performed in the division, he shall notify the chief of the purchasing division of the department of administration. [The]
2. Upon receipt of the notice required pursuant to subsection 1, the chief shall, pursuant to the provisions of chapter 333 of NRS, [have the work performed in] select and contract with a commercial printing establishment [.] that is located within the State of Nevada, unless:
(a) A commercial printing establishment that is located outside the State of Nevada submits a bid, proposal or price that is more than 5 percent lower than any bid, proposal or price submitted for the same proposed work by a commercial printing establishment that is located within this state; or
(b) No commercial printing establishment that is located within the State of Nevada submits a bid, proposal or price for the proposed work.
If two or more bids, proposals or prices submitted for the proposed work are identical, the chief shall select a commercial printing establishment in the manner set forth in subsection 4 of NRS 333.300.
3. The cost of [the] work performed pursuant to this section must be paid out of the contingent fund provided for the expenses of state officers or out of the fund provided for the support of the [commission] office, department or institution requiring the work, as the case may be.
[2.] 4. The state controller shall not draw his warrant in payment for any printed matter except such as is authorized by subsection 1.
5. As used in this section, "institution" includes the University and Community College System of Nevada.
Sec. 2. NRS 333.340 is hereby amended to read as follows:
333.340 [Every] Except as otherwise provided in NRS 344.160, every contract or order [shall] must be awarded to the lowest responsible bidder, taking into consideration:
1. The location of the using agency to be supplied.
2. The qualities of the articles to be supplied.
3. Their conformity with the specifications.
4. The purposes for which they are required.
5. The dates of delivery.
Sec. 3. NRS 333.470 is hereby amended to read as follows:
333.470 1. The University and Community College System of Nevada, the state industrial insurance system and local governments as defined in NRS 354.474, conservation districts and irrigation districts in the State of Nevada may obtain supplies, materials and equipment on a voluntary basis through the facilities of the purchasing division.
2. The chief shall issue bulletins from time to time to:
(a) Each state agency;
(b) Each local governmental agency;
(c) Each irrigation district;
(d) Each conservation district;
(e) The University and Community College System of Nevada; and
(f) The state industrial insurance system,
indicating the supplies, materials and equipment available and the prices thereof.
3. The specifications for all bids for supplies, materials or equipment to be furnished pursuant to the provisions of subsection 1 must be so written that all suppliers of the market in the industry or business concerned are given an opportunity to bid pursuant to notice as provided for in this chapter.
4. The University and Community College System of Nevada shall comply with the provisions of NRS 344.160.
