AN ACT relating to state parks; restricting the use of a fire within state parks and recreational facilities; prohibiting the possession and discharge of fireworks and other explosives within or into a state park or recreational facility; providing penalties; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 Chapter 407 of NRS is hereby amended by adding thereto the provisions set forth as sections 2 and 3 of this act.
Sec. 2 1. A person shall not light, build or maintain a fire in a state park or recreational facility unless the fire is:
(a) In a portable stove, barbecue or fireplace; or
(b) On the ground and within an enclosure provided by the division or approved by the supervisor of the park or recreational facility.
2. If a fire is maintained in a grill or stove, the fire must be contained within the rim of the grill or stove.
3. The material burned in a fire within a state park or recreational facility must not be longer than 22 inches.
4. Any person who violates any provision of this section is guilty of a misdemeanor.
Sec. 3 1. A person shall not:
(a) Have in his possession within a state park; or
(b) Discharge within or into a state park,
fireworks or other explosives of any type.
2. Any person who violates any provision of this section is guilty of a misdemeanor.
Sec. 4 The provisions of this act do not apply to offenses that are committed before the effective date of this act.
Sec. 5 The provisions of subsection 1 of NRS 354.599 do not apply to any additional expenses of a local government that are related to the provisions of this act.
Sec. 6 This act becomes effective upon passage and approval.
