AN ACT relating to older persons; requiring the welfare division of the department of human resources to establish and maintain a system of protective services for certain older persons who are victims of abuse, neglect or exploitation or who are unable to protect their own interests; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 Chapter 422 of NRS is hereby amended by adding thereto a new section to read as follows:
1. The welfare division shall establish and maintain a system of protective services for older persons who are victims of abuse, neglect or exploitation or who are unable to protect their own interests. The system must include the investigation of reports of abuse, neglect or exploitation of older persons.
2. The system of protective services established pursuant to subsection 1 may include, without limitation:
(a) Assessing an older person to determine any assistance he may need;
(b) Performing an initial investigation of any report of abuse, neglect or exploitation of an older person;
(c) Using a multidisciplinary team to determine the appropriate course of action in response to a report of abuse, neglect or exploitation of an older person;
(d) Assisting an older person with any immediate need as a result of abuse, neglect or exploitation of the older person;
(e) Cooperating with the administrator or guardian of an older person or with a law enforcement officer to detect, investigate, prevent and reduce any abuse, neglect or exploitation of the older person; or
(f) Any combination of paragraphs (a) to (e), inclusive.
3. As used in this section:
(a) "Abuse" has the meaning ascribed to it in subsection 1 of NRS 200.5092;
(b) "Exploitation" has the meaning ascribed to it in subsection 2 of NRS 200.5092;
(c) "Neglect" has the meaning ascribed to it in subsection 3 of NRS 200.5092; and
(d) "Older person" has the meaning ascribed to it in subsection 4 of NRS 200.5092.
