AN ACT relating to the committee on benefits; increasing the number of members of the committee; requiring that certain members of the committee be appointed by the governor from lists of nominees submitted by certain organizations; providing that public employees do not lose accrued leave for the time spent away from their employment while serving as members of the committee; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 NRS 287.041 is hereby amended to read as follows:
287.041 1. There is hereby created the committee on benefits to be composed of [five] seven members as follows:
[1. Two members must be selected by the board of directors of the Nevada State Employees' Association.
2. One member must be the director of the department of administration.
3. Two members, one of whom must be an employee retired from state service, must be appointed by the governor.]
(a) Six of the members must be participants in the state's group health insurance plan, and the governor shall appoint:
(1) Two members from a list of five nominees submitted by the State of Nevada Employees Association or its successor organization.
(2) One member who is employed in the classified service of the state who is selected from a list of three nominees submitted by the Service Employees International Union or its successor organization.
(3) One member from a list of three nominees submitted by the Retired Public Employees of Nevada or its successor organization.
(4) One member from lists of nominees submitted by employee organizations representing professional employees of the University and Community College System of Nevada. Each such organization may submit a list of not more than three nominees.
(5) One member from lists of nominees submitted by employee organizations representing employees of local governments that participate in the state's group health insurance plan. Each such organization may submit a list of not more than three nominees.
(b) The director of the department of administration is an ex officio member of the committee and may designate a representative to serve in his place on the committee or to attend a meeting of the committee in his place.
2. After the initial terms, each appointed member of the committee serves a term of 3 years.
Sec. 2. NRS 287.042 is hereby amended to read as follows:
287.042 1. A majority of the members of the committee on benefits constitutes a quorum for the transaction of business.
2. No member who is a public employee may receive any compensation for his services as a member of the committee. Any member who is [employed in the service of the state] a public employee must be granted leave from his duties to engage in the business of the committee without loss of his regular compensation. Such leave does not reduce the amount of the member's [annual] other accrued leave.
3. A member of the committee who is not a public employee is entitled to receive $80 per day for his attendance at meetings of the committee.
Sec. 3. 1. The terms of the persons who are members of the committee on benefits on September 30, 1997, expire on that date.
2. As soon as is practicable on or before October 1, 1997, the governor shall appoint as members of the committee on benefits:
(a) Two persons from the list of nominees submitted by the State of Nevada Employees Association to initial terms that begin on October 1, 1997, and expire on September 30, 1998.
(b) One person from the list of nominees submitted by the Service Employees International Union and one person from the list of nominees submitted by the Retired Public Employees of Nevada to initial terms that begin on October 1, 1997, and expire on September 30, 1999.
(c) One person from the lists of nominees submitted by employee organizations representing professional employees of the University and Community College System of Nevada and one person from the lists of nominees submitted by employee organizations representing employees of local governments that participate in the state's group health insurance plan to initial terms that begin on October 1, 1997, and expire on September 30, 2000.
Sec. 4. This act becomes effective on July 1, 1997.
