AN ACT relating to legislators; broadening the provisions prohibiting the loss of job seniority of a legislator because of his absence from his employment while attending a legislative session to include employment by this state or a local government; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 NRS 218.044 is hereby amended to read as follows:
218.0441. [On and after April 8, 1967, no] No contract of employment wherein a [private individual, corporation, association or partnership] person, this state or a local government is the employer is lawful or enforceable in this state [which works] if it provides for a loss of job seniority of any person [by reason] because of his absence from his regular duties or place of employment while attending a regular or special session of the legislature of this state as a member thereof.
2. The presence in a general contract between an employer and employees or their representative of any provision which violates subsection 1 does not affect the validity of any other [and separable] severable provision.
Sec. 2 The amendatory provisions of section 1 of this act apply to any contract of employment described in that section which is entered into or renewed on or after October 1, 1997.
