SUMMARY--Makes various changes to provisions regulating practice of Oriental medicine. (BDR 54-730)

AN ACT relating to Oriental medicine; making various changes to provisions regulating the practice of Oriental medicine; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 NRS 634A.120 is hereby amended to read as follows:
634A.120 1. [Examinations] Standard examinations must be given at least [once] twice a year at a time and place fixed by the board.
2. [Applicants] If an applicant does not pass a standard examination, he may take the examination again. The board shall not restrict the number of times an applicant may take a standard examination.
3. Except as otherwise provided in NRS 634A.140 and 634A.150, applicants for licenses to practice acupuncture or Oriental medicine or to practice as an assistant in acupuncture must be examined in the appropriate subjects as determined by the board. The board shall, in a document that it makes available to applicants, specify the subjects that will be covered by the examination.
Sec. 2 NRS 634A.140 is hereby amended to read as follows:
634A.140 The board shall issue separate licenses to practice respectively Oriental medicine or acupuncture, as appropriate, where the applicant:
1. Has [successfully] :
(a) Successfully completed a course of study of [:
(a) Four] 4 years in Oriental medicine [; or
(b) Three] or 3 years in acupuncture [,] at any college or school approved by the board which is located in any country, territory, province or state or has qualifications considered equivalent by the board;
[2. Has practiced Oriental medicine, including acupuncture and herbal medicine for 6 years; and
3. Passes the] ; or
(b) Earned a bachelor's degree from an accredited college or university and has completed an apprenticeship or tutorial training program for acupuncture that is approved by the board or the equivalent governing body of any other state; and
2. Has passed the standard examination of the board [.] to practice Oriental medicine or acupuncture or an examination of another state that has been approved by the board.
Sec. 3 NRS 634A.150 is hereby amended to read as follows:
634A.150 The board shall issue a license for an assistant in acupuncture where the applicant:
1. Has successfully completed a course of study in acupuncture in any college or school approved by the board which is located in any country, territory, province or state requiring an attendance of 3 years , or has successfully completed an apprenticeship or tutorial training program for acupuncture that is approved by the board or the equivalent governing body of any other state, or has other qualifications deemed by the board to be equivalent to the course of study [;] or the apprenticeship or tutorial training program; and
2. Passes the standard examination of the board for an assistant in acupuncture or an examination of another state that has been approved by the board, or has other qualifications deemed by the board to be [the equivalent.] equivalent to the standard examination.
