AN ACT relating to the Nevada highway patrol; requiring the department of personnel to calculate the average salaries of certain law enforcement personnel; requiring that the proposed budget of the department of motor vehicles and public safety include salaries for officers of the Nevada highway patrol which are based on those calculations; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1 Chapter 284 of NRS is hereby amended by adding thereto a new section to read as follows:
1. The director shall calculate the respective average salaries as of July 1 of each even-numbered year of all police officers of equivalent rank employed by:
(a) Law enforcement agencies of cities whose population is 50,000 or more;
(b) Law enforcement agencies of counties whose population is 100,000 or more; and
(c) Metropolitan police departments formed pursuant to chapter 280 of NRS in counties whose population is 100,000 or more.
2. The director shall forward the figures of the average salaries calculated pursuant to this section to the chief of the budget division of the department of administration and the director of the department of motor vehicles and public safety not later than July 15 of each even-numbered year.
Sec. 2 Chapter 353 of NRS is hereby amended by adding thereto a new section to read as follows:
1. In preparing its proposed biennial budget, the department of motor vehicles and public safety shall set the respective salaries of the officers of the Nevada highway patrol at amounts which:
(a) For the first year of the biennium, are equal to or greater than the average salary of police officers of equivalent rank as calculated by the director of the department of personnel pursuant to section 1 of this act; and
(b) For the second year of the biennium, are equal to the respective amounts proposed pursuant to paragraph (a), plus an adjustment for inflation, if any. The amount of the adjustments must be determined by multiplying the respective amounts proposed pursuant to paragraph (a) by the percentage of inflation, if any. The Consumer Price Index published by the United States Department of Labor for July preceding each biennium must be used in determining the percentage of inflation.
2. In preparing the proposed executive budget, the chief shall ensure that the salaries of the officers of the Nevada highway patrol, as included in the proposed budget of the department of motor vehicles and public safety, are established in accordance with the provisions of subsection 1.
Sec. 3 NRS 353.150 is hereby amended to read as follows:
353.150 NRS 353.150 to 353.246, inclusive, and section 2 of this act may be cited as the State Budget Act.
Sec. 4 Not later than 10 days after the effective date of this act, the director of the department of personnel shall:
1. Calculate the average salaries paid to police officers as of July 1, 1996, pursuant to section 1 of this act; and
2. Forward the figures of the average salaries calculated pursuant to subsection 1 to:
(a) The chairman of the senate standing committee on finance;
(b) The chairman of the assembly standing committee on ways and means; and
(c) The fiscal analysis division of the legislative counsel bureau.
Sec. 5 This act becomes effective upon passage and approval.
