MINUTES OF THE SENATE COMMITTEE ON TRANSPORTATION Sixty-eighth Session May 15, 1995 The Senate Committee on Transportation was called to order by Chairman William R. O'Donnell, at 11:31 a.m., on Monday, May 15, 1995, in the Senate Chambers of the Legislative Building, Carson City, Nevada. There was no Agenda. There was no Attendance Roster. Neal, Jr. Senator Raymond C. Shaffer Senator O. C. Lee STAFF MEMBERS PRESENT: Diane Rea, Committee Secretary SENATE BILL 326: Revises standard for determining operation of vehicle or vessel while intoxicated. (BDR 43-1582) Senator O'Donnell introduced Senate Amendment No. 504 to Senate Bill (S.B.) 326, and explained that what this amendment does is reflect the DUI (Driving Under the Influence) on a persons record for a period of 7 years. A subsequent accident with .05 BAC (Blood Alcohol Count) and above, within that 7-year period, will count against a person as a .10 BAC. A person will be treated as a .10 BAC driver required to complete educational requirements and is given all the penalties. SENATOR WASHINGTON MOVED TO ADOPT THE AMENDMENT NO. 504 TO SENATE BILL 326. Senator Porter asked for a legal opinion on the amendment. Senator O'Donnell said he will bring the amendment back to the Senate Committee on Transportation for further discussion, due to time on the Senate floor.
