MINUTES OF THE SENATE COMMITTEE ON NATURAL RESOURCES Sixty-eighth Session May 8, 1995 The Senate Committee on Natural Resources was called to order by Chairman Dean A. Rhoads, at 2:38 p.m., on Monday, May 8, 1995, in Room 224 of the Legislative Building, Carson City, Nevada. Exhibit A is the Agenda. There was no Attendance Roster. Sande, III, Lobbyist, Western States Petroleum Association Chairman Rhoads opened the work session on Senate Bill (S.B.) 402. SENATE BILL 402: Revises provisions relating to labeling of lubricating oil and used and recycled motor oil. John P. Sande, III, Lobbyist, Western States Petroleum Association, came forward to walk the committee through submitted amendments as outlined in a document (Exhibit B) prepared by Fred Welden, Chief Deputy Research Analyst, Legislative Counsel Bureau. Chairman Rhoads asked for a motion on S.B. 402. SENATOR REGAN MOVED TO AMEND AND DO PASS S.B. 402. SENATOR McGINNESS SECONDED THE MOTION. THE MOTION CARRIED. (SENATOR ADLER WAS ABSENT FOR THE VOTE.) ***** Senator Jacobsen offered some remarks on the amendments outlined by Mr. Sande, and recognized they were made "after the fact." Senator Regan requested that Senator Jacobsen's remarks be put in the record. Senator Jacobsen said: ......I want to indicate I think these amendments are very proper and I think you have to realize that the use of oil doesn't contaminate itself, it is the kind of fuel that is burned in an engine that really provides the contamination. Whether it is diesel fuel or gasoline, they all have sulphur in it and so that is where the contamination comes from. I am pleased to see the API [American Petroleum Institute] things in here and that is very common within the industry and especially with manufacturers. It usually states on the label of the piece of machinery, the API that is required and also the viscosity. So I think it spells it out almost identical to, you might say, pure oil, and the use of it should be encouraged because it is a hazardous product after it is contaminated with sulphur. So you have got to be concerned about the environment. I can only think of the day when I used to dump, every other week, 10 barrels of oil that came from the ski resort, and I covered every cemetery in Douglas County to kill the weeds. Chairman Rhoads asked Senator Jacobsen to handle S.B. 402 and the amendment when it reaches the Senate General File. Chairman Rhoads opened the work session on Senate Bill (S.B.) 409. SENATE BILL 409: Revises provisions governing qualifications of administrator of division of agriculture of department of business and industry. Chairman Rhoads explained the Nevada Division of Agriculture wanted the words accounting or business administration added, and they wanted to amend the measure to include effective upon passage and approval. Mr. Welden added that Senator Adler had requested that public administration also be included in the amendments, as outlined in Exhibit B. SENATOR McGINNESS MOVED TO AMEND AND DO PASS S.B. 409. SENATOR REGAN SECONDED THE MOTION. THE MOTION CARRIED. (SENATOR ADLER WAS ABSENT FOR THE VOTE.) ***** Chairman Rhoads opened the work session on Senate Bill (S.B.) 410. SENATE BILL 410: Revises provisions governing payment of expenses relating to estrays. Chairman Rhoads said there were no amendments to the measure and called for a motion on S.B. 410. SENATOR REGAN MOVED TO DO PASS S.B. 410. SENATOR JAMES SECONDED THE MOTION. THE MOTION CARRIED.
