MINUTES OF THE SENATE COMMITTEE ON GOVERNMENT AFFAIRS Sixty-eighth Session March 2, 1995 The Senate Committee on Government Affairs was called to order by Chairman Ann O'Connell, at 6:00 p.m., on Thursday, March 2, 1995, in Room 227 of the Legislative Building, Carson City, Nevada. Raggio (Excused) GUEST LEGISLATORS PRESENT: Senator Maurice Washington STAFF MEMBERS PRESENT: Dana Bennett, Senior Research Analyst Ricka Benum, Primary Secretary Tanya Morrison, Committee Secretary OTHERS PRESENT: Irene Porter, Lobbyist, Nevada Homebuilders Association Irene Porter, asked the committee for a bill draft request. She based this request on the fact that for 25 to 30 years there has been a practice on water and sewer main line extension. She stated builders or developers pay 100 percent of the cost for water or sewer connections. She said on a main line extension, an area may be opened up for development. A developer may only need an 8-inch pipe to suit his needs, but a 16-inch pipe is needed to serve the area. The builder installs the 16-inch pipe, requiring no revenue from the local government. She explained when this change is done, the city, county or state has entered into a refunding agreement with the builder where they get the oversizing portion of the money on the pipe back over a period of years as people connect on, or connection fees are collected and given to the person who does the work on the oversizing. The second option is an oversizing agreement where the builder is paid out of an existing oversizing account. Ms. Porter stated no one in the entire state has been following statute for 30 years. She said some projects are being held up in Clark County because of the compliance issue. SENATOR SHAFFER MOVED TO ASK FOR A BILL DRAFT REQUEST. SENATOR O'DONNELL SECONDED THE MOTION. THE MOTION CARRIED. (SENATORS RAGGIO AND TOWNSEND WERE ABSENT FOR THE VOTE.) ***** Senator Washington asked the committee for a bill draft request for an amendment to Nevada Revised Statutes 284.362 regarding catastrophic leave. He explained this request is regarding the use of catastrophic leave for the death of an immediate family member (Exhibit C). SENATOR O'DONNELL MOVED TO ASK FOR A BILL DRAFT REQUEST. SENATOR TITUS SECONDED THE MOTION. THE MOTION CARRIED. (SENATORS RAGGIO AND TOWNSEND WERE ABSENT FOR THE VOTE.) ***** Senator O'Connell explained the work session planned for the evening would not take place as Senator Townsend and Senator Raggio are absent. Senator O'Connell gave the committee materials to study for the next work session. She stated the work session would be held on Wednesday, March 8, 1994. She explained to the committee upon adjournment of the regularly scheduled meeting on Wednesday, March 8, the committee would begin the work session and asked the committee to clear their calendars from 2:00 p.m. to 5:30 p.m. for that day.
