MINUTES OF THE SENATE COMMITTEE ON COMMERCE AND LABOR Sixty-eighth Session June 12, 1995 The Senate Committee on Commerce and Labor was called to order by Chairman Randolph J. Townsend, at 9:30 a.m., on Monday, June 12, 1995, in Room 227 of the Legislative Building, Carson City, Nevada. Exhibit A is the Agenda. Exhibit B is the Attendance Roster. Neal STAFF MEMBERS PRESENT: Beverly Willis, Committee Secretary Scott Young, Senior Research Analyst OTHERS PRESENT: Scott Walshaw, Commissioner, Financial Institutions Division, Department of Business and Industry John Sande, Lobbyist, Nevada Bankers Association Doug Walther, Deputy Attorney General, Commerce Section, Office of the Attorney General Sam McMullen, Lobbyist, Nevada State Board of Nurses Donny Loux, Chief, Office of Community Based Services, Rehabilitation Division, Department of Employment, Training and Rehabilitation The meeting opened with the presentation of Bill Draft Request (BDR) 55-883. BILL DRAFT REQUEST 55-883: Provides for interstate and international banking. Senator Townsend, Senator Lowden and Senator O'Connell all declared either they, or a spouse are members of the board of various financial institutions. Scott Walshaw, Commissioner, Financial Institutions Division, Department of Business and Industry, explained the purpose of this BDR, (Exhibit C The original is on file in the Research Library.) noting it attempts to implement provisions of federal legislation, which creates nationwide interstate banking and allows for states to opt in or out of interstate branching. Mr. Walshaw continued, noting this BDR might implement interstate branching on our (Nevada) terms, rather than those set out by the federal government. Mr. Walshaw proceeded with his explanation of Exhibit C. In answer to several questions from Senator Augustine pertaining to intrastate and interstate, Mr. Walshaw continued: Interstate branching, essentially in this context, means that an out of state bank or holding company could either have already acquired some entity here under our interstate banking law. Under this statute they would be allowed to convert their charter here, essentially extinguishing that charter here and allowing the offices here to operate as branches. ...If they do it in a manner which is prescribed under the statute ... they may operate branches under interstate basis, where now under interstate banking law they can only do that by acquiring an entity, or setting up a new entity and operating it as a separate charter in each state where they choose to operate. Mr. Walshaw continued with an explanation of Exhibit C, noting provisions in this BDR are consistent with federal law. Senator Lowden and Mr. Walshaw conferred on the effect this legislation might have on the financial institution with which Senator Lowden is now connected. John Sande, Lobbyist, Nevada Bankers Association, joined the conversation, noting this legislation will not give this financial institution any more or less advantage. More comments were offered by Senator Regan. SENATOR REGAN MOVED TO INTRODUCE BILL DRAFT REQUEST 55-883. SENATOR LOWDEN SECONDED THE MOTION. THE MOTION CARRIED. (SENATOR NEAL WAS ABSENT FOR THE VOTE). * * * * * At this time, Mr. Walshaw introduced Doug Walther, Senior Deputy Attorney General, Commerce Section, Office of the Attorney General. Mr. Walshaw went on to note sections of this BDR also includes language dealing with international banking. At this time, Mr. Sande gave an explanation, again noting this legislation will allow interstate banking; i.e., a bank outside of Nevada having a branch in Nevada without having to set up a separate Nevada corporation. Mr. Sande continued noting concerns from his organization. The hearing then opened on Assembly Bill (A.B.) 645. ASSEMBLY BILL 645: Authorizes unlicensed personal assistant to perform certain services for person with physical disability under certain circumstances. First to testify on this legislation was Sam McMullen, Lobbyist, Nevada State Board of Nurses. Mr. McMullen noted reasoning behind this legislation and introduced Donny Loux, Chief, Office of Community Based Services, Rehabilitation Division, Department of Employment, Training and Rehabilitation. Ms. Loux gave background on this legislation and presented Exhibit D and Exhibit E. (The original of Exhibit E is on file at the Research Library.) Mr. McMullen then answered questions and gave an explanation of A.B. 645. SENATOR O'CONNELL MOVED TO DO PASS ASSEMBLY BILL 645. SENATOR LOWDEN SECONDED THE MOTION. THE MOTION CARRIED UNANIMOUSLY. * * * * * Exhibit F was presented to the committee, however there was no testimony.
