MINUTES OF THE ASSEMBLY COMMITTEE ON NATURAL RESOURCES, AGRICULTURE AND MINING Sixty-eighth Session January 23, 1995 The Committee on Natural Resources, Agriculture and Mining was called to order at 1:15 p.m., on Monday, January 23, 1995, Chairman Marcia de Braga presiding in Room 321 of the Legislative Building, Carson City, Nevada. Ziegler, Senior Research Analyst OTHERS PRESENT: Elsie Dupree, Nevada Wildlife Federation; Joe Johnson, Coalition for Nevada Wildlife, Sierra Club; Tom Bentz, Nevada Animal Wise Use and Welfare Alliance, Stephanie D. Licht, Elko County and Nevada Wool Growers/Sheep Commission. The meeting was called to order by Chairman Marcia de Braga. She welcomed members of the committee and introduced staff. Mrs. de Braga informed the committee Mr. Carpenter would chair meetings on Wednesdays and she would chair the Monday meetings. Roll call was taken with all members present. The first order of business was to discuss the Standing Rules for the committee (Exhibit C). Mrs. de Braga informed the members revisions would be needed to be in compliance with the Standing Rules of the Assembly. Mr. Bache said an amendment would be needed to comply with the tie vote issue in the Assembly. ASSEMBLYMAN BACHE MOVED FOR APPROVAL OF THE STANDING RULES SUBJECT TO AMENDMENT. ASSEMBLYMAN CARPENTER SECONDED THE MOTION. The Chairman suggested rule number five of the standing rules conflicts with the assembly rules and would require a change to a two-thirds majority for committee introduction of a bill or resolution. Mr. Bache pointed out he had language on the tie vote rule which would bring the standing rules into compliance with the assembly rules. The standing rules could be amended at the next meeting. Mr. Neighbors asked if a tie vote would be brought back to committee for consideration. Chairman de Braga replied the committee would reconsider a bill many times and would try to resolve conflicts before sending a tie bill to the floor for a vote. Mr. Carpenter pointed out if a member wanted to change his vote on the floor from what was voted in committee they should notify the chairman. THE MOTION CARRIED UNANIMOUSLY BY THOSE PRESENT. Mrs. de Braga stated the committee will attempt to hear all bills which come before them as they are introduced on the Assembly floor. The bills will be scheduled within 15 days. She indicated most of the voting on bills would be done in work sessions with the exception of non-controversial issues. The five day notice of posting for committees and subcommittees would be followed if possible. Mr. Carpenter emphasized the committee would see real cooperation between Mrs. de Braga and himself. He informed the committee the chairmen would try and accommodate members of the public and those who would like to testify. Mr. Carpenter stated if a member saw anything out of order to let the chairmen know of their concerns. They will strive to move bills to the floor in a timely manner and have a smooth working committee. Mr. David S. Ziegler, Senior Research Analyst, presented an Issue Brief, (Exhibit D), prepared by him and Mr. Fred W. Welden, Chief Deputy Research Director, and staff, to the Senate Committee on Natural Resources. He presented an overview of the work the committee accomplished during the 1993 session. A preview of the 1995 session and closing remarks were made by Mr. Ziegler. The Research Division of the Legislative Counsel Bureau would be most happy to assist members of the legislature in any way they could, stated Mr. Ziegler. He said research offices could be found in Room 125 of the Legislative Building and in the Sedway Office Building first floor. Mrs. de Braga asked Mr. Ziegler if Mr. Ballow of the Agriculture Department had resigned. Mr. Ziegler confirmed he had and would not be testifying but a representative of the department would be at the meeting. She thanked Mr. Ziegler for the report. The chairman reviewed organizational information with the committee. She asked if the members would please let the chairmen or secretary know if they would not be at a meeting. Mrs. de Braga informed the members of a joint meeting with the Senate Natural Resource Committee on February 22, 1:30 p.m., Room 119 regarding a hearing on "Landfills." Rural Nevada has been upset over Federal Regulations they can not comply with and how to pay for what was mandated. Mrs. de Braga felt it was important as a committee to listen attentively to the people who come to testify. The members owe them respect for their point of view.
