MINUTES OF THE ASSEMBLY COMMITTEE ON JUDICIARY Sixty-eighth Session January 24, 1995 The Committee on Judiciary was called to order at 10:40 a.m., on Wednesday, January 24, 1995, Chairman Humke presiding in Room 119 of the Legislative Building, Carson City, Nevada. These bills are all from an interim study committee, Assembly Concurrent Resolution (A.C.R. 71), which was chaired by Mr. Anderson. It is generally considered to be an element of legislative etiquette to vote to introduce a bill. It is generally accepted that you will vote for introduction. It only means that it will be heard by the committee. Mr. Anderson read the summaries to the committee and asked for committee introduction of A.C.R. study commencing with Bill Draft Request (B.D.R.): BDR 14-232 Summary--Requires certain information concerning use of alcohol or controlled substances to be included in records of criminal history. BDR 43-233 Summary--Requires peace officers to receive training in detection of use and abuse of alcohol and controlled substances. BDR 40-234 Summary--Expands circumstances under which certain criminal offenders may elect treatment for abuse of alcohol or drugs before sentencing. BDR 40-235 Summary--Revises provisions governing placement of criminal offenders in programs of treatment for abuse of alcohol and drugs before sentencing. BDR 40-236 Summary--Expands circumstance under which proceedings and sentences for persons convicted of certain offenses relating to controlled substances may be suspended or reduced. BDR S-237 Summary--Makes appropriation to bureau of alcohol and drug abuse in rehabilitation division of department of employment, training and rehabilitation for support of certain programs of treatment for criminal offenders who abuse alcohol or drugs. BDR S-238 Summary--Makes appropriation to Eighth Judicial District for expansion of its program of treatment for abuse of alcohol or drugs. BDR 43-239 Summary--Provides for deferred prosecution of certain persons accused of driving under influence of intoxicating liquor or controlled substance. BDR 43-240 Summary--Requires offender convicted of driving under influence of intoxicating liquor or controlled substance for first time to be placed in program of treatment under certain circumstances. BDR 40-241 Summary--Eliminates mandatory minimum penalty for unlawful use of certain controlled substances. BDR 32-242 Summary--Increases excise taxes on liquor to provide treatment for alcohol and drug abusers who have been accused or convicted of crimes. BDR 16-243 Summary--Makes various changes to provisions governing assignment of offenders to program for treatment of abuser of alcohol or drugs established by director of department of prisons. BDR R-244 Summary--Urges peace officers to identify and arrest, and court to impose prompt, meaningful and consistent sanctions upon, juveniles who violate laws related to alcohol and drugs. BDR 5-245 Summary--Requires revocation of driver's licenses of certain juveniles who drive under influence of intoxicating liquor or controlled substance. BDR 43-246 Summary--Requires finding that juvenile was driving under influence of intoxicating liquor or controlled substance to be included in his driver's record for certain period. BDR 43-247 Summary--Requires evaluation and treatment relating to abuse of alcohol or other drugs for juvenile offenders under certain circumstances. BDR 5-248 Summary--Requires revocation or delay in issuance of driver's licenses of certain juveniles who unlawfully purchase, consume or possess alcoholic beverage. BDR 16-249 Summary--Establishes within department of prisons position of coordinator of programs for treatment of offenders who abuse alcohol or drugs. BDR R-250 Summary--Urges Congress and President of United States to oppose legalization of certain controlled substances. BDR S-251 Summary--Provides for study of effectiveness of programs for treatment of alcohol and drug abuse. ASSEMBLYMAN PERKINS MOVED FOR INTRODUCTION OF THESE BILL DRAFTS. ASSEMBLYMAN CARPENTER SECONDED THE MOTION. THE MOTION CARRIED UNANIMOUSLY BY THOSE PRESENT. Mr. Anderson recommended to committee members to obtain a copy of Bulletin No. 959 (A.C.R. 71 committee report) of this session. Hopefully, the committee will post them during the two week Las Vegas adjournment. Mr. Carpenter felt it would be appropriate if each member of the committee had the report. The Chair stated that can be taken care of and asked for any other comments.
