FOREIGN TRADE ZONES

NRS 237A.010        State and political subdivisions may apply for authority to establish, operate and maintain foreign trade zones.

FOREIGN TRADE ZONES

      NRS 237A.010  State and political subdivisions may apply for authority to establish, operate and maintain foreign trade zones.  The State of Nevada, any county, city, town or other political subdivision in this State may apply for authority to establish, operate and maintain foreign trade zones in this State, pursuant to the provisions of an Act of Congress entitled “A bill to provide for the establishment, operation and maintenance of foreign trade zones in ports of entry in the United States, and to expedite and encourage foreign commerce,” 19 U.S.C. §§ 81a to 81u, inclusive.

      NRS 237A.020  Organization of corporation to establish, operate and maintain foreign trade zone.  Corporations whose purpose is to establish, operate and maintain foreign trade zones under the provisions of the laws of the United States may be organized under and shall comply with the appropriate provisions of title 7 of NRS.

      NRS 237A.030  Application by corporation to establish, operate and maintain foreign trade zone.  Each foreign trade zone corporation organized under and subject to the appropriate provisions of title 7 of NRS, as provided in NRS 237A.020, may apply for and receive from the proper United States authorities a grant of the privilege of establishing, operating and maintaining a foreign trade zone, wholly or partly within the State.

      NRS 237A.040  Operation of foreign trade zone by corporation.  Each foreign trade zone corporation may establish, operate and maintain a foreign trade zone, upon receipt of and in accordance with the grant provided in NRS 237A.030, subject to the laws of the United States and with all the powers and subject to all the restrictions contained in the appropriate provisions of title 7 of NRS.

      NRS 237A.050  Liberal construction.  NRS 237A.010 to 237A.040, inclusive, shall be liberally construed in order to facilitate trade and commerce in the State of Nevada.

TRADE DISTRICTS

      NRS 237A.060  Application by political subdivision for trade district.  The governing body of any political subdivision of this State or the governing bodies of two or more political subdivisions of this State, acting together, may apply to the Governor for the certification of a trade district pursuant to any federal law providing for the establishment and administration of a trade district in Nevada.

      NRS 237A.070  Approval and certification.

      1.  The Governor shall approve an application made pursuant to NRS 237A.060 and certify a trade district if:

      (a) All of the requirements imposed by federal law for the establishment and administration of such a district are met;

      (b) The application and certification comply with the applicable provisions of the law of this State; and

      (c) The welfare of this State is advanced by the certification of such a district.

      2.  If a trade district is certified pursuant to subsection 1, the Governor shall designate a proper authority to administer the district.
