GENERAL PROVISIONS

      NAC 62H.010  Definitions. (NRS 62H.200)  As used in this chapter, unless the context otherwise requires, the words and terms defined in NAC 62H.015 to 62H.060, inclusive, have the meanings ascribed to them in those sections.

      NAC 62H.015  “Arrest” defined. (NRS 62H.200)  “Arrest” has the meaning ascribed to it in NRS 171.104.

      NAC 62H.020  “Child” defined. (NRS 62H.200)  “Child” has the meaning ascribed to it in NRS 62A.030.

      NAC 62H.030  “Delinquent act” defined. (NRS 62H.200)  “Delinquent act” means any act listed in subsection 2 of NRS 62B.330 other than a traffic offense.

      NAC 62H.040  “Division” defined. (NRS 62H.200)  “Division” means the Division of Child and Family Services of the Department of Human Services.

      NAC 62H.045  “Gender identity or expression” defined. (NRS 62H.200)  “Gender identity or expression” has the meaning ascribed to it in NRS 651.050.

      NAC 62H.050  “Referral” defined. (NRS 62H.200)  “Referral” means the point in time when a child is brought to the attention of the system of juvenile justice in this State and an official record is opened to document the child’s case.

      NAC 62H.060  “Status offense” defined. (NRS 62H.200)  “Status offense” means a delinquent act which would not be a crime if committed by a person who is at least 21 years of age.

COLLECTING AND ANALYZING INFORMATION CONCERNING JUVENILE JUSTICE

      NAC 62H.095  Authorization to collect and report further information. (NRS 62H.200)  The provisions of this chapter do not prohibit the collection and reporting of information that is not required to be collected and reported by those provisions.

      NAC 62H.100  Identification number for referred child. (NRS 62H.200)

     1.  Each juvenile court and local juvenile probation department shall assign an identification number to each child referred to the court or department. The identification number must be unique to the child.

     2.  If a child who has previously been assigned an identification number pursuant to this section is referred to a juvenile court other than the court that assigned the previous number, the juvenile court shall assign a new identification number to the child and report to the Division all identification numbers previously assigned to the child.

      NAC 62H.105  Maintenance by juvenile court and local juvenile probation department of list of identification numbers and confidentiality of children’s names. (NRS 62H.200)  Each juvenile court and local juvenile probation department shall maintain:

     1.  A list that correlates the name of each child referred to the court or department with the child’s unique identification number.

     2.  The confidentiality of each child’s name and shall not report the name or address of any child to the Division.

      NAC 62H.115  Availability of information to certain state agencies. (NRS 62H.200)  A state agency which provides information to the Division pursuant to this chapter may obtain any information collected pursuant to this chapter from the Juvenile Justice Programs Office of the Division. The information will be provided to a requesting agency electronically.

      NAC 62H.125  Published reports of compiled information by Division. (NRS 62H.200)  The Division will compile the information received by it pursuant to this chapter and will publish a report of the information on an Internet website maintained by the Division once in each calendar year. The report must include, without limitation, the information reported pursuant to NAC 62H.135.

      NAC 62H.135  Annual report by Youth Parole Bureau, juvenile courts and local juvenile probation departments. (NRS 62H.200)  On or before December 1 of each year, the Youth Parole Bureau and each juvenile court and local juvenile probation department shall, for the immediately preceding year, submit to the Division, on a form prescribed by the Division, a report that includes, as applicable:

     1.  The total number of children over whom the juvenile court has jurisdiction, disaggregated by race, sex and gender identity or expression, at each of the following points of contact:

     (a) Referral;

     (b) Arrest;

     (c) Citation;

     (d) Filing of petition;

     (e) Entry of dispositional orders;

     (f) Adjudication;

     (g) Out-of-home placement;

     (h) Formal probation placement;

     (i) Commitment to the Division; and

     (j) Placement on parole.

     2.  The total number of children released on parole or over whom the juvenile court has jurisdiction for whom the department of juvenile services conducted a mental health screening pursuant to NRS 62E.506.

     3.  Whether a child released on parole or over whom the juvenile court has jurisdiction has engaged in recidivism during each of the 3 years after the date on which the initial arrest, citation, referral, adjudication, commitment or placement in an out-of-home facility occurred.

     4.  The overall rate of recidivism for children released on parole or over whom the juvenile court has jurisdiction.

     5.  The overall percentage of case closures for children released on parole or over whom the juvenile court has jurisdiction.

     6.  The total number of individualized case plans developed pursuant to NRS 62E.507, 62E.525 or 213.1078 for children released on parole or over whom the juvenile court has jurisdiction.

     7.  To the extent not prohibited by law, the total number of children convicted in the adult criminal justice system, excluding any conviction for which the record of the conviction was dismissed, expunged, sealed or otherwise destroyed.

     8.  For the purposes of subsections 3 and 4, a juvenile court or local juvenile probation department shall measure recidivism by tracking when a child with an arrest, citation, referral, adjudication, commitment or placement in an out-of-home facility is:

     (a) Arrested or rearrested.

     (b) Referred or rereferred.

     (c) Adjudicated or readjudicated.

     (d) Committed or recommitted.

     (e) Found to be in violation of probation or parole.

     (f) Convicted by a court, to the extent that acquiring such information is not prohibited by law.

      NAC 62H.145  Monthly report by local juvenile probation departments concerning detention of children who commit status offenses. (NRS 62H.200)

     1.  Each local juvenile probation department that operates a local facility for the detention of children shall, on or before the 15th day of each month, for each child who committed a status offense and was detained in the facility during the immediately preceding calendar month, report to the Division, in the form prescribed by the Division, the following information:

     (a) The initials of the child, identification number assigned to the child pursuant to NAC 62H.100 or case number of the status offense;

     (b) The date of birth of the child;

     (c) The gender identity or expression of the child;

     (d) The sex of the child;

     (e) The race of the child;

     (f) The date and time at which the child was detained in the facility;

     (g) The date and time at which a detention hearing was held;

     (h) The offense for which the child was detained; and

     (i) Any prior adjudication of the child.

     2.  In addition to the information required by subsection 1, the report must include, for each child who committed a status offense who was detained for more than 24 hours:

     (a) Whether the detention was made based on a determination that the child:

          (1) Is a ward of the federal court or held pursuant to a federal statute;

          (2) Has run away from another state and a jurisdiction within that state has issued a want, warrant or request for the child; or

          (3) Is accused of violating a valid court order;

     (b) If the detention was made based on a determination that the child violated a valid court order:

          (1) An explanation of why the local juvenile probation department determined that the valid court order was violated; and

          (2) Documentation demonstrating why the child could not be placed in a less restrictive setting;

     (c) The date and time at which the determination was made to detain the child for more than 24 hours; and

     (d) The date and time at which the child was released from the facility.

      NAC 62H.155  Report by Youth Parole Bureau, juvenile courts, local juvenile probation departments and regional facilities concerning discharge of children. (NRS 62H.200)

     1.  The Youth Parole Bureau, each juvenile court and local juvenile probation department and the staff of each regional facility for the treatment and rehabilitation of children shall, for each child discharged from parole or over whom the juvenile court has terminated its jurisdiction, as applicable, report to the Division, in the form prescribed by the Division, the following information:

     (a) The information described in NRS 62H.210;

     (b) The identification number assigned to the child pursuant to NAC 62H.100;

     (c) The date on which the child was referred to the Bureau, court, department or facility;

     (d) The gender identity or expression of the child;

     (e) Whether the household in which the child resides is at, above or below the federally designated level signifying poverty;

     (f) The last grade completed by the child and whether the child received a high school diploma or successfully completed the high school equivalency assessment selected by the State Board of Education;

     (g) The results of any risk assessment or mental health screening conducted on the child pursuant to NRS 62E.506 at the time of referral or commitment and at the time the child was discharged or jurisdiction was terminated;

     (h) Whether the child was placed in a home or committed to an agency or institution and, if so, the type of home, agency or institution in which the child was placed or to which the child was committed, if applicable;

     (i) Whether any programs or services were received by the child, and, if so, the types of programs or services received, including, without limitation:

          (1) Services for mental health, including, without limitation, counseling for groups of parents on issues relating to raising a family;

          (2) Services for special needs, including, without limitation, counseling on managing anger; and

          (3) Education, counseling or treatment for a substance use disorder;

     (j) The most serious delinquent act or status offense for which the child was referred or for which the child was:

          (1) Placed under informal supervision pursuant to NRS 62C.200;

          (2) Placed under the supervision of a juvenile court pursuant to a supervision and consent decree in accordance with NRS 62C.230; or

          (3) Adjudicated in need of supervision;

     (k) Whether the child was referred based on:

          (1) A new arrest, referral or citation; or

          (2) A technical violation; and

     (l) Whether the child was detained, and, if so, the date on which the child was detained and the date on which the child was released from detention.

     2.  The Youth Parole Bureau, each juvenile court and local juvenile probation department and the staff of each regional facility for the treatment and rehabilitation of children shall submit to the Division the information required by subsection 1:

     (a) For each child discharged from parole or over whom the juvenile court terminates its jurisdiction between July 1 and December 31, on or before the immediately following June 1; and

     (b) For each child discharged from parole or over whom the juvenile court terminates its jurisdiction between January 1 and June 30, on or before the immediately following December 1.

     3.  Upon request, the Youth Parole Bureau, each juvenile court and local juvenile probation department and the staff of each regional facility for the treatment and rehabilitation of children shall furnish the Division with any data requested by the Commission concerning performance measures for determining the effectiveness of the juvenile justice system.

     4.  For the purposes of this section, the jurisdiction of a juvenile court over a child is terminated when the child is no longer under the supervision of the juvenile court or any probation officer or parole officer.

     5.  As used in this section, “technical violation” has the meaning ascribed to it in NRS 176A.510.
