AN ACT relating to motor vehicles; providing for the issuance of special license plates
for the support of the rights of animals, including support for the activities
of People for the Ethical Treatment of Animals or its successor; imposing a fee
for the issuance or renewal of such license plates; and providing other matters
properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter
482 of NRS is hereby amended by adding thereto a
1-2 new section to read as
follows:
1-3 1. Except as otherwise provided in this
subsection, the department, in
1-4 cooperation with People for the Ethical Treatment of Animals or its
1-5 successor, shall design, prepare and issue license plates for the
support
1-6 of the rights of animals, using any colors and designs that the
1-7 department deems appropriate. The department shall not design,
prepare
1-8 or issue the license plates unless it receives at least 250 applications
for
1-9 the issuance of those plates.
1-10 2. If the department receives at least 250
applications for the
1-11 issuance of license plates for the support of the rights of
animals, the
1-12 department shall issue those plates for a passenger car or light
1-13 commercial vehicle upon application by a person who is entitled to
1-14 license plates pursuant to NRS 482.265 and who otherwise complies
with
1-15 the requirements for registration and licensing pursuant to this
chapter.
1-16 A person may request that personalized prestige license plates
issued
1-17 pursuant to NRS 482.3667 be combined with license plates for the
1-18 support of the rights of animals if that person pays the fees for
the
1-19 personalized prestige license plates in addition to the fees for
the license
2-1 plates for the support of the rights of animals pursuant to
subsections 3
2-2 and 4.
2-3 3. The fee for license plates for the support of
the rights of animals is
2-4 $35, in addition to all other applicable registration and license
fees and
2-5 motor vehicle privilege taxes. The license plates are renewable
upon the
2-6 payment of $10.
2-7 4. In addition to all other applicable
registration and license fees and
2-8 motor vehicle privilege taxes and the fee prescribed in subsection
3, a
2-9 person who requests a set of license plates for the support of the
rights of
2-10 animals must pay for the initial issuance of the plates an
additional fee of
2-11 $25 and for each renewal of the plates an additional fee of $20, to
be
2-12 distributed to People for the Ethical Treatment of Animals or its
2-13 successor pursuant to subsection 5.
2-14 5. The department shall deposit the fees
collected pursuant to
2-15 subsection 4 with the state treasurer for credit to the state
general fund.
2-16 The state treasurer shall, on a quarterly basis, distribute the
fees
2-17 deposited pursuant to this subsection to People for the Ethical
Treatment
2-18 of Animals or its successor for its activities in support of the
rights of
2-19 animals.
2-20 6. If, during a registration year, the holder of
license plates issued
2-21 pursuant to the provisions of this section disposes of the vehicle
to which
2-22 the plates are affixed, the holder shall:
2-23 (a) Retain the plates and
affix them to another vehicle that meets the
2-24 requirements of this section if the transfer and registration fees
are paid
2-25 as set forth in this chapter; or
2-26 (b) Within 30 days after
removing the plates from the vehicle, return
2-27 them to the department.
2-28 Sec. 2. NRS 482.216 is hereby amended to read as follows:
2-29 482.216 1. Upon the request of a new vehicle dealer, the
department
2-30 may authorize the new
vehicle dealer to:
2-31 (a) Accept applications for the registration of the new motor
vehicles he
2-32 sells and the related fees
and taxes;
2-33 (b) Issue certificates of registration to applicants who satisfy
the
2-34 requirements of this
chapter; and
2-35 (c) Accept applications for the transfer of registration pursuant
to NRS
2-36 482.399 if the applicant
purchased from the new vehicle dealer a new
2-37 vehicle to which the
registration is to be transferred.
2-38 2. A new vehicle dealer who
is authorized to issue certificates of
2-39 registration pursuant to
subsection 1 shall:
2-40 (a) Transmit the applications he receives to the department within
the
2-41 period prescribed by the
department;
2-42 (b) Transmit the fees he collects from the applicants and properly
2-43 account for them within the
period prescribed by the department;
2-44 (c) Comply with the regulations adopted pursuant to subsection 4;
and
2-45 (d) Bear any cost of equipment which is necessary to issue
certificates
2-46 of registration, including
any computer hardware or software.
2-47 3. A new vehicle dealer who
is authorized to issue certificates of
2-48 registration pursuant to
subsection 1 shall not:
2-49 (a) Charge any additional fee for the performance of those
services;
3-1 (b) Receive compensation from the department for the performance of
3-2 those services;
3-3 (c) Accept applications for the renewal of registration of a motor
3-4 vehicle; or
3-5 (d) Accept an application for the registration of a motor vehicle
if the
3-6 applicant wishes to:
3-7 (1) Obtain special license plates pursuant to NRS 482.3667 to
3-8 482.3825, inclusive [;] , and section 1 of this act;
or
3-9 (2) Claim the exemption from the vehicle privilege tax provided
3-10 pursuant to NRS 361.1565 to
veterans and their relations.
3-11 4. The director shall adopt
such regulations as are necessary to carry
3-12 out the provisions of this
section. The regulations adopted pursuant to this
3-13 subsection must provide for:
3-14 (a) The expedient and secure issuance of license plates and decals
by
3-15 the department; and
3-16 (b) The withdrawal of the authority granted to a new vehicle dealer
3-17 pursuant to subsection 1 if
that dealer fails to comply with the regulations
3-18 adopted by the department.
3-19 Sec. 3. NRS 482.500 is hereby amended to read as follows:
3-20 482.500 1. Except as otherwise provided in subsection 2
or 3,
3-21 whenever upon application
any duplicate or substitute certificate of
3-22 registration, decal or
number plate is issued, the following fees must be
3-23 paid:
3-24 For a certificate of registration..... $5.00
3-25 For every substitute number plate or set of plates........................................... 5.00
3-26 For every duplicate number plate or set of plates......................................... 10.00
3-27 For every decal displaying a county name.................................................. .50
3-28 For every other decal, license plate sticker or tab.................................... 5.00
3-29 2. The following fees must
be paid for any replacement plate or set of
3-30 plates issued for the
following special license plates:
3-31 (a) For any special plate issued pursuant to NRS 482.3667,
482.3672,
3-32 482.3675, 482.370 to
482.376, inclusive, or 482.379 to 482.3816,
3-33 inclusive, and section 1 of this act, a
fee of $10.
3-34 (b) For any special plate issued pursuant to NRS 482.368, 482.3765,
3-35 482.377 or 482.378, a fee of
$5.
3-36 (c) For any souvenir license plate issued pursuant to NRS 482.3825
or
3-37 sample license plate issued
pursuant to NRS 482.2703, a fee equal to that
3-38 established by the director
for the issuance of those plates.
3-39 3. A fee must not be
charged for a duplicate or substitute of a decal
3-40 [requested] issued pursuant to NRS 482.37635.
3-41 4. The fees which are paid
for duplicate number plates and decals
3-42 displaying county names must
be deposited with the state treasurer for
3-43 credit to the motor vehicle
fund and allocated to the department to defray
3-44 the costs of duplicating the
plates and manufacturing the decals.
3-45 5. As used in this section:
3-46 (a) “Duplicate number plate” means a license plate or a set of
license
3-47 plates issued to a
registered owner which repeat the code of a plate or set of
4-1 plates previously issued to
the owner to maintain his registration using the
4-2 same code.
4-3 (b) “Substitute number plate” means a license plate or a set of
license
4-4 plates issued in place of a
previously issued and unexpired plate or set of
4-5 plates. The plate or set of
plates does not repeat the code of the previously
4-6 issued plate or set.
4-7 Sec. 4. On or before July 1, 2005, the department of motor vehicles
4-8 and public safety shall
determine and publicly declare the number of
4-9 applications it has received
for the issuance of license plates pursuant to
4-10 section 1 of this act.
4-11 Sec. 5. 1. This act becomes
effective on July 1, 2001.
4-12 2. The amendatory
provisions of this act expire by limitation on July 1,
4-13 2005, if on that date the
department of motor vehicles and public safety has
4-14 received fewer than 250
applications for the issuance of license plates
4-15 pursuant to section 1 of
this act.
